Customers should read the information below, which at the time of sale
forms a contract of procedure to ensure a speedy, no-nonsense transaction for both parties.
Liability issues are also covered.

Payment

Painting/s must be paid for in a full single payment by Priority Electronic Payment. Payment must be made in United Kingdom Pounds Sterling to the full value as requested by invoice. Electronic Payment must be cleared through the banking system before ownership (of item/s) is transferred. Once payment and collection of the painting/s has been conducted absolutely no refund will be made for whatever reason.

 

Liability

No liability will be accepted for any damage/s to the painting/s or frame/s or any part of the item/s no matter howsoever it has been caused either after the sale or subsequently. It is up to the customer to satisfy himself/ herself of the item's condition prior to the sale being conducted. Once a sale has been conducted the transaction is completed.

 

Ownership

Any failure in payment on the part of the buyer/ customer for whatever reason will automatically cancel right of ownership of the painting/s and this will return back to the gallery and will be enforced by law if necessary.

 

Collection

A specific date (agreeable to the gallery) must be notified for the collection of the work/s and to take place within fourteen days after the sale negotiations have been completed (and the Electronic Payment having being cleared). The painting/s must be arranged to be collected and insured by the buyer, and the safe transportation/ removal of the painting/s to the new location is strictly the buyer's responsibility. (Note: The gallery does not arrange for transportation, insurance or removal.)
Once the painting is handled by removers all responsibility is negated by the gallery, even whilst the painting is being removed from the premises of the gallery. Absolutely no refund or part refund of any kind will be made for negligence or damage of any kind occurring, or accusations of damage occurring, whilst the painting was at the gallery premises or being removed from the gallery premises.

 

Condition

No claim is either made or intended for the longevity of paintings, or materials, of any kind. It is up to the buyer to ensure that he/she is satisfied of the painting/s condition prior to sale and that no mishandling occurs which might be detrimental to the painting/s or that the work is not exposed to unfavourable climate, temperature, dampness or other harsh conditions etc. Asquith-ArtGallery. co. uk will not accept liability for any damage(s) that might occur to paintings, either at the time of collecting or subsequently, and customers buy any painting in an 'as is' condition and accept the painting/s with any imperfections to canvas, finish, frames or any other part of the painting/s.
Absolutely no liability will be accepted for subsequent damage of any kind and no refund or part refund will be made whatsoever.
No recommendation will be made by the gallery for painting storage or display and it is up to the customer to use common sense in all these associated matters.


Enquiries and Sales

Paintings will only be reserved for fourteen days after an agreement to buy (and this is at the discretion of Asquith -ArtGallery. co. uk). If payment is not received by the end of this period the work/s will be available for sale to another customer. In the event of sale/s the gallery reserves the right to keep a copy of the work/s on the Web site for howsoever long it chooses to display example/s of the artist's work and also to keep records of the painting/s. The Web site will include a 'sold' indication to avoid confusion to customers.

Royalty, Resale or Printing

The buyer MUST agree to the following before any sale can be conducted.
If for any reason a painting is resold (within 12 months) by the customer a 10% gross commission must be paid to the gallery. The gallery must be notified immediately of the sale details. Payment must be made by Priority Electronic Payment within fourteen days of the sale being concluded.
If the buyer runs prints for sale in whatever format, 20% of the gross price must be paid to the gallery as a royalty to the artist or 20% gross on howsoever many items are run or sold in the future. Full details and payment must be made to the gallery within fourteen days of whenever sales are completed by Priority Electronic Payment. This is to pass on any continued royalty to the artist. If the buyer resells the painting/s this print royalty must be honoured by the subsequent purchaser/s if prints are run at any time, and subsequent purchasers of any work must be made aware of this arrangement.


Limited Edition Prints

As a rule the gallery does not favour limited edition prints, but where prints have been run from a painting this will always be stated clearly to the buyer and also made clearly visible on the Web site.


Prices for Paintings

Asquith-ArtGallery. co. uk reserves the right to change or alter price information prior to any new enquiry at any time of its own choosing. This can be up or down subject to market trends or any other circumstances or reasons as it sees fit. Asquith-ArtGallery. co. uk is in no way bound to price structure and will not give reasons for its charges, changes in prices or future alterations of any kind.


Customer Service

Asquith-ArtGallery. co. uk will always endeavour to provide a fast and efficient service to ensure customer satisfaction, as mentioned in its 'Terms and Conditions'. However, Asquith-ArtGallery. co. uk will not be held in any way responsible or liable for any break in liaison with 'enquiries' or return of calls for whatever reason.
Asquith-ArtGallery. co. uk will not be held responsible or liable in any way for any delay on its own part when dealing with enquiries or customers at any time and for whatever reason. This also applies to any unavoidable circumstance that might arise. In the unlikely event of prolonged delay, 'Purchasing' customers will always be informed by telephone or written communication as to the nature of the delay, which will be overcome as soon as possible.
Obviously, Asquith-ArtGallery. co. uk cannot be held responsible or liable (whatsoever) for any disruption to service caused by any national or regional crisis, civil disturbance, outbreak of warfare, circumstances beyond its control, fire, flood or any other natural or accidental calamity that might affect its sphere of business and trading etc.
